LOCEA'S Purpose

LOCEA's primary purpose is to review all legislative rules of the HEPC & CCTCE, State Board of Education, and any other agency directed by law to promulgate rules under the authority of §29A-3A and §29A-3B.  None of these agencies or boards, except the State Board of Education, may promulgate a legislative rule without the approval of LOCEA.  It may also review such other rules as it determines appropriate, which means it can but is not required to review emergency, procedural and interpretive rules as well as the legislative ones.

In addition, LOCEA is directed to make a continuing investigation, study, and review of the practices, policies, and procedures of HEPC, CCTCE, State Board of Education, and all other matters related to education in West Virginia.  As such, they are required to make annual reports to the Legislature of the results of such investigation, study, and review.  In large part, this relates to the oversight of the implementation of legislation.

To carry out its responsibilities, LOCEA is empowered and authorized to examine witnesses and to subpoena such persons and books, records, documents, papers, or any other tangible things as it believes should be examined to make a complete investigation.
